1. INTRODUCTION

Welcome to Workers.pk, a digital marketplace connecting freelancers and clients in Pakistan. These Terms and Conditions ("Terms") govern your access to and use of the Workers.pk website, services, and applications (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. DEFINITIONS

  • "Workers.pk," "we," "us," or "our" refers to the operators of the Platform.
  • "User," "you," or "your" refers to any individual or entity that accesses or uses the Platform.
  • "Seller" refers to any User who offers services on the Platform.
  • "Buyer" refers to any User who purchases services from Sellers.
  • "Gig" refers to a service offered by a Seller on the Platform.
  • "Content" refers to any text, graphics, images, music, software, audio, video, information, or other materials.

3. ACCOUNT REGISTRATION

3.1. To access certain features of the Platform, you must register for an account.

3.2. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

3.4. You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old.

4. PLATFORM RULES

4.1. For Sellers:

  • You must deliver services as described in your Gig description.
  • You must communicate professionally with Buyers.
  • You are responsible for the quality of work delivered.
  • You may not offer services that violate Pakistani law or our Platform policies.

4.2. For Buyers:

  • You must pay for services as agreed upon.
  • You must provide clear instructions and communicate professionally with Sellers.
  • You may not request services that violate Pakistani law or our Platform policies.

4.3. For All Users:

  • You may not use the Platform for any illegal or unauthorized purpose.
  • You may not violate any laws in your jurisdiction.
  • You may not post or transmit harmful content, including but not limited to viruses, malware, or content that is harassing, abusive, or fraudulent.
  • You may not impersonate another person or entity.

5. FEES AND PAYMENTS

5.1. Workers.pk charges fees for the use of the Platform. These fees are clearly displayed before payment is made.

5.2. Sellers receive payment after successful completion of services, subject to a service fee deducted by Workers.pk.

5.3. All payments are processed through our secure payment system. We do not encourage or support off-platform payments.

5.4. Fees are non-refundable except as described in our Refund Policy or as required by Pakistani law.

6. OWNERSHIP AND INTELLECTUAL PROPERTY

6.1. Sellers retain ownership of their pre-existing intellectual property.

6.2. Upon full payment, Buyers receive the rights to the deliverables as specified in the Gig description, unless otherwise stated.

6.3. You retain ownership of your Content, but grant Workers.pk a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your Content on the Platform.

7. DISPUTES BETWEEN USERS

7.1. Users agree to resolve disputes directly with each other in good faith.

7.2. If Users cannot resolve a dispute, Workers.pk may mediate at its discretion.

7.3. Workers.pk reserves the right to make a final decision on disputes related to the Platform.

8. LIMITATION OF LIABILITY

8.1. Workers.pk is not liable for:

  • Content posted by Users.
  • Direct or indirect damages arising from use of the Platform.
  • Loss of profits, data, or other intangible losses.
  • Disputes between Users.
  • Service interruptions or technical issues.

8.2. Our total liability to you for any claim arising from or relating to these Terms shall not exceed the amount paid by you to Workers.pk during the six (6) months prior to such claim.

9. TERMINATION

9.1. Workers.pk reserves the right to terminate or suspend your account and access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other Users or us.

9.2. You may terminate your account at any time by contacting us.

9.3. Upon termination, your right to use the Platform will immediately cease.

10. CHANGES TO TERMS

10.1. Workers.pk reserves the right to modify these Terms at any time.

10.2. We will notify Users of significant changes to these Terms.

10.3. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

11. GOVERNING LAW

11.1. These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

11.2. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.

12. PRIVACY POLICY

12.1. Our Privacy Policy, available on the Platform, is incorporated into these Terms by reference.

12.2. By using the Platform, you consent to our collection and use of personal information as described in our Privacy Policy.
